Terms of Service

ELJIKA provides AI-powered WhatsApp assistants that help businesses answer enquiries, explain services, and assist with bookings. These Terms govern your use of ELJIKA.

You must be able to form a binding contract under applicable law and have authority to act for the business you represent.

You are responsible for the accuracy of account information and for keeping access credentials secure. Notify us promptly of any unauthorized use.

You may use ELJIKA only in accordance with these Terms and applicable law. You must not misuse the service or attempt to interfere with its operation.

You are responsible for the accuracy of the business information you provide (services, prices, hours, booking rules, etc.), for complying with laws that apply to your business, and for how you use customer information obtained through ELJIKA.

ELJIKA uses AI to generate responses. AI outputs may be incomplete or incorrect. You remain responsible for reviewing and configuring your assistant and for decisions made based on its outputs.

ELJIKA may help collect information needed for bookings. Final confirmation, calendar management, and fulfilment remain your responsibility unless we expressly agree otherwise in writing.

You must not use ELJIKA to:

• Violate any law or third-party rights
• Send spam or deceptive content
• Harass, harm, or exploit others
• Attempt to reverse-engineer or disrupt the service

ELJIKA relies on third-party platforms (including WhatsApp/Meta) and infrastructure providers. Their terms and availability affect howELJIKA works. We are not responsible for those third-party services.

ELJIKA and its branding, software, and content remain our property or that of our licensors. You retain rights in the business content you provide. You grant us a licence to use that content solely to operate and improve the service for you.

Each party agrees to protect the other's confidential information and use it only as needed to perform under these Terms.

ELJIKA is currently in early access. Pricing and payment terms may be introduced separately when commercial plans become available. Any paid plans will be communicated clearly before charges apply.

We aim to keep ELJIKA available, but we do not guarantee uninterrupted or error-free service. Maintenance, outages, and third-party issues may affect availability.

We may suspend or terminate access if you breach these Terms or if needed to protect the service or others. You may stop using ELJIKA at any time.

ELJIKA is provided "as is" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities. Our total liability for any claim relating to ELJIKA is limited to the amounts you paid us (if any) in the twelve months before the claim.

You agree to indemnify and hold us harmless from claims arising from your use of ELJIKA, your business content, or your breach of these Terms, to the extent permitted by law.

We may update these Terms. Material changes will be communicated where practical. Continued use after changes constitutes acceptance where permitted by law.

These Terms are governed by the laws of Kenya. Disputes will be subject to the exclusive jurisdiction of the courts of Kenya, unless mandatory law provides otherwise.
